Privacy Policy

This Privacy Policy describes how Barkly Protects, Inc. (“Barkly” or “we,” “us,” or “our”) protects the privacy of any information and data Barkly collects from or about you (“you”, “customer” or “your”) and your employees, contractors and other end users (together, “End Users”) of our end-point security service (the “Service”).

1. Information Covered

This Privacy Policy covers our information practices related to your use of our Service, as well as your use of our websites that link to this Privacy Policy, including www.barkly.com and www.portal.barkly.com (the “Website(s)”). Our Websites may contain links to third party websites. The information practices or the content of such other websites is governed by the privacy statements of such other websites. We encourage you to review the privacy statements of other websites to understand their data and information collection and use practices.

2. Information Collected

We collect different kinds of information and data relating to you and End Users through use of and registration on our Website or the purchase and use of our Service.

  • When expressing an interest in obtaining additional information about the Service or registering to use or purchasing or using the Service, we require you to provide us with personal contact information, such as name, company name, address, phone number, and email address. If you are a corporate customer, we may also ask you to provide additional optional information, for example: company annual revenues, number of employees, or industry.
  • When purchasing the Service, we may require you to provide us with financial qualification and billing information, such as billing name and address, and credit card number (“Billing Information”).
  • If you use the Service, we collect information and data related to your use of the Service, including but not limited to the types and nature of security incidents, the operation and effects of the Service, as well as system, software and other data information about your computer.
  • As you navigate our Websites, we may also collect information through the use of commonly-used information-gathering tools, such as cookies and Web beacons. Information gathered may include standard information from your web browser (such as browser type and browser language), your Internet Protocol (“IP”) address, and the actions you take on our websites (such as the webpages viewed and the links clicked).

We refer to all of the information and data described above as “Customer Data.”

We value the privacy and security of Customer Data and take reasonable measures to protect it in accordance with applicable law.

We may collect and temporarily cache and store information relating to End Users as necessary to provide the Service. This information may include personally identifiable information or protected health information stored on End Users’ machines. We will store any such information only to the extent and for the time necessary to analyze the behavior of End Users’ machines and to stop attacks and will delete it once our analysis has been completed.

We do not allow children under the age of 13 to use the Website or to register as users and will not knowingly collect or solicit personal information from anyone under the age of 13. No one under the age of 13 should provide any personal information on or through our Website or otherwise. In the event we learn that we have collected personal information from a child under age 13, we will terminate the account and delete the information. If you believe that we might have any information from or about a child under 13, please contact us at legal@barkly.com. Minors should not use our Website or post any information or other content without adult supervision.

3. Use of Customer Data

We use Customer Data to interact with you, register you as a customer, collect payment information from you, provide the Service to you, operate, support, monitor and improve the Service, and analyze and collect information on security incidents.

We also use Customer Data to provide you with relevant information about Barkly and the Service. For example, we may use information you provide to contact you to further discuss your interest in the Service and to send you information regarding Barkly, its affiliates, and its partners, such as information about promotions or events.

When you purchase the Service, you will likely supply credit card information to us and we consider such information to be Customer Data. Any credit card information that is provided to us is used solely to check the financial qualifications and collect payment from prospective and actual customers. We strive to adhere to PCI data security standards, including using fully PCI compliant credit card processors.

4. Website Navigational Information
Cookies, Web Beacons and IP Addresses

We use commonly used information-gathering tools, such as cookies and Web beacons, to collect information as you navigate our Websites (“Web Site Navigational Information”). This section sets out the type of navigational information used on our websites and how this information may be used.

Cookies

We use cookies to make Website interactions easier and more meaningful. When you visit one of our Websites, our servers send a cookie to your computer. Cookies do not, in and of themselves, personally identify you; they merely recognize your Web browser. Unless you choose to identify yourself to us, either by responding to a promotional offer, opening an account, or filling out a Web form (such as a “Contact Me” or other Web form provided by Barkly), you remain anonymous to us.

Web Beacons

We may use Web beacons alone or in conjunction with cookies to compile information about customers’ and visitors’ usage of our Websites and interaction with our emails. Web beacons are clear electronic images that can recognize certain types of information on your computer, such as cookies, when you viewed a particular website tied to the Web beacon, and a description of a website tied to the Web beacon. For example, we may place Web beacons in marketing emails that notify us when you click on a link in the email that directs you to one of our Websites. Web beacons are utilized to operate and improve our Websites and email communications.

IP Addresses

When you visit our Websites, we collect your Internet Protocol (“IP”) addresses to track and aggregate non-personal information. For example, we may uses IP addresses to monitor the regions from which you navigate the Websites.

Social Media Features

Our Websites may also use social media features, such as the Facebook 'like' button. These features may collect your IP address and which page you are visiting, and may set a cookie to enable the feature to function properly. You may be given the option to post information about your activities on our Website to a profile page of yours that is provided by a third party social media network in order to share with others within your network. Social media features are either hosted by a third party or hosted directly on our Website. Your interactions with these features are governed by the privacy policy of the company providing the relevant social media features.

5. Public Forums, Refer a Friend, and Customer Testimonials

We may provide bulletin boards, blogs, or chat rooms on our Websites. Any personal information you choose to submit in such a forum may be read, collected, or used by others who visit these forums, and may be used to send you unsolicited messages. We are not responsible for the personal information you choose to submit in these forums.

You may also elect to use our referral program to inform colleagues about us. When using the referral program, we request the colleague’s name and email address. We will automatically send the person a one-time email inviting him or her to visit us, but we do not store this information.

As stated in our Terms of Service, we may use the names of corporate customers in a list of our customers and on our website and, where permitted, testimonials, on our Websites that contain information such as your name and title. Please send us an email at support@barkly.com if you want to opt out. We do obtain consent prior to posting any testimonials.

6. Sharing of Information Collected
Service Providers

We may share Customer Data with our contracted service providers so that these service providers can provide services on our behalf.

Business Partners

From time to time, we may partner with other companies to jointly offer products or services. If you purchase or specifically express interest in a jointly-offered product or service, we may share Customer Data collected in connection with your purchase or expression of interest with our joint promotion partner(s). However, we do not control our business partners’ use of Customer Data, and their use of the information will be in accordance with their own privacy policies. If you do not wish for your information to be shared in this manner, do not purchase or specifically express interest in a jointly offered product or service.

Third Parties

We do not authorize the collection of Customer Data by third parties through advertising technologies deployed on our Websites, nor do we share Customer Data with any third parties collected from our Websites, except as provided in this Privacy Policy.

Billing

Barkly uses a third-party service provider to manage credit card and payment processing. This service provider is not permitted to store, retain, or use billing information except for the sole purpose of credit card and payment processing on our behalf. The service provider is PCI compliant.

Aggregated Data

As indicated in our Terms of Service, you acknowledge and agree that we can use Customer Data collected from you for any lawful purpose, including transferring, assigning, licensing or selling such data to third parties, provided such data is in an aggregated and anonymized format. Aggregated data does not include any information that could be used to identify you and does not include your personal or contact information.

Compelled Disclosure

We may use or disclose Customer Data if required by law or if we reasonably believe that use or disclosure is necessary to protect our rights and/or to comply with a judicial proceeding, court order, or legal process.

7. International Transfer of Information Collected

We store Customer Data in the United States. However, this Privacy Policy shall apply even if we transfer Customer Data to other countries.

8. Unsubscribe

You may manage your receipt of marketing and non-transactional communications by clicking on the “unsubscribe” link located on the bottom of our marketing emails. Additionally, you can unsubscribe here.

9. Correcting and Updating Your Information

You may update or change your registration information by editing your user or organization record at any time. To update a user profile, please login to your Barkly Portal with your username and password and navigate to the Settings page.

10. Data Retention

You understand and agree that it is our practice to make backup copies of Customer Data and that we may store and maintain Customer Data for such period of time as we determine is necessary. You agree that our right to store and maintain Customer Data shall survive the termination of your Service subscription term, the Agreement covering the Service, and this Privacy Policy.

11. Changes to This Privacy Policy

We reserve the right to change this Privacy Policy, and will provide notification of the material changes to this Privacy Policy by posting such changes on our Websites. Changes will take effect immediately upon posting.
